Introduction
Socrademy ("we," "us," or "our") is committed to protecting the privacy of our users, particularly children and students. This Privacy Policy outlines our practices regarding the collection, use, and disclosure of personal information when you use our web application, Socrademy (the "App"), which integrates with Google for Education accounts. We comply with the Children's Online Privacy Protection Act (COPPA), the Family Educational Rights and Privacy Act (FERPA), and the Protection of Pupil Rights Amendment (PPRA).
1. Information We Collect
Information from Google for Education:
When you use your Google for Education account to log into Socrademy, we may collect information such as your name, email address, and classroom information (if shared by your school/district). We only collect information necessary to provide the App's functionality.
Presently, we only utilize user creation and facilitation through Google for Education and API integrations in order to provide the services we need to vested stakeholders while also serving to protect user information.
We adhere to Google Workplace for Education Privacy Policy, including the Limited Use requirements.
We adhere to Google's API Services User Data Policy, including the Limited Use requirements.
Student Data (FERPA and COPPA):
We only collect student data that is necessary for educational purposes, as authorized by the educational institution.
If a student is under 13 (COPPA), we require verifiable parental consent before collecting any personal information, or we operate under the school's authority to give consent.
We may collect student-generated content (e.g., assignments, responses) within the App for educational purposes.
Usage Data:
We may collect information about how you use the App, such as login times, features used, and performance data. This data is used to improve the App and for analytical purposes.
No Collection of Sensitive Information:
We do not collect sensitive personal information such as social security numbers, medical information, or financial information.
2. How We Use Information
Educational Purposes:
To facilitate the creation, distribution and validation of learning experiences to vested and pertinent parties, including students, parents, educators, administrators and other persons designated by the school district.
To provide the features and functionality of the App.
To facilitate educational activities and assignments.
To track student progress and performance.
App Improvement:
To analyze usage data and improve the App's functionality and user experience.
Communication:
To provide support and respond to inquiries from users and educational institutions.
To provide updates and notifications about the app.
Compliance:
To comply with applicable laws and regulations.
3. Information Sharing and Disclosure
3.1 Educational Institutions:
Specific Data Sharing: We may share student data, including but not limited to, assignment completion status, grades, progress reports, and student-generated content, with authorized personnel within the student's educational institution (teachers, administrators, etc.).
Purpose of Sharing: This sharing is solely for educational purposes, such as monitoring student progress, providing feedback, and improving instructional practices.
Authorization: Data sharing with educational institutions is done under the authority of the school or district that has implemented the use of Socrademy. We rely on the schools authorization to give consent when dealing with students under 13.
3.2 Service Providers:
Categories of Service Providers: This includes, but is not limited to, cloud hosting providers (e.g., for data storage), analytics providers (e.g., for usage analysis), and customer support platforms.
Data Processing Agreements: We enter into strict data processing agreements with these service providers, ensuring they:
Process data only for specified purposes.
Maintain appropriate security measures.
Adhere to confidentiality obligations.
Prohibit them from using the information for their own marketing purposes.
Data Minimization: We only share the minimum amount of information necessary for the service provider to perform their functions.
3.3 Legal Compliance:
Examples of Legal Obligations: This includes responding to subpoenas, court orders, or other legal processes, as well as complying with requests from law enforcement agencies.
Notification: When legally permissible, we will make reasonable efforts to notify the affected educational institution or parent before disclosing information in response to a legal request.
Protecting Rights: We may also disclose information to protect our rights or the rights of others, such as to prevent fraud or abuse.
3.4 Business Transfers:
In the event of a merger, acquisition, or sale of assets, user information may be transferred as part of the transaction.
Due Diligence: In the event of a business transfer, we will conduct thorough due diligence to ensure that the acquiring entity will maintain the same level of privacy and security protections.
Notification: We will provide notice to users and educational institutions of any business transfer that may result in a change in the control or use of their personal information.
Contractual Obligations: We will ensure that any transfer of data is subject to contractual obligations that protect the confidentiality and security of the information.
3.5 Aggregated and Anonymized Data:
Use of Aggregated Data: We may aggregate and anonymize user data to create statistical reports or for research purposes. This data cannot be used to identify individual users.
Sharing Aggregated Data: We may share aggregated and anonymized data with third parties for research, analysis, or other legitimate purposes.
No Re-identification: We take steps to ensure that aggregated and anonymized data cannot be re-identified.
3.6 Student Generated Content:
Ownership: Student generated content is owned by the student, or the school district depending on the agreement with the district.
Limited Sharing: Sharing of this content is limited to authorized educational personnel, and to the student and their parent.
Parental Review: Parents have the right to review their child's generated content.
3.7 No Third-Party Marketing:
Explicit Prohibition: We explicitly prohibit the sharing of student data with third parties for marketing or advertising purposes.
No Targeted Advertising: We do not engage in targeted advertising based on student data.
Parental Consent:
If a user is under 13, we require verifiable parental consent before collecting personal information, or we rely upon school consent under COPPA.

Limited Collection:
We limit the collection of personal information from children under 13 to what is reasonably necessary for the App's educational purposes.
School Official Exception:
We act as a "school official" with a "legitimate educational interest" as defined by FERPA, as authorized by the educational institution.

We maintain the confidentiality of student records and only use them for educational purposes.
Parent Rights:
Parents have the right to access and amend their child's education records, as provided by FERPA.
Student Surveys and Evaluations:
We will obtain prior written consent from parents before students participate in surveys or evaluations that reveal sensitive information, as required by PPRA.
Marketing Information:
We do not collect or share identifiable or student specific information for marketing purposes.
7. Data Security
We implement reasonable security measures to protect user information from unauthorized access, use, or disclosure.
Data is encrypted in transit and at rest.
We regularly review and update our security practices.
8. Data Retention
We retain user information only for as long as necessary to provide the App's services and as required by applicable laws and regulations.
School records will be retained in accordance with the schools policies.
When data is no longer needed it will be securely deleted.

We may update this Privacy Policy from time to time. We will notify users of any material changes by posting the new Privacy Policy on our website or within the App.
We will provide appropriate notice to parents and educational institutions regarding changes that affect student data.
